What is MCA and How is it useful for the Public?

Ministry of Corporate Affairs (MCA) is a government portal containing details of all the companies incorporated in India. It has details of all the types of companies and Limited Liability Partnership(LLP). The government of India provides sharing the information about your organization on the public platform, as soon you file annual returns of the Private Limited Company it will be shown on the website by the company master data search. The information on company registration is always available on the official website of the Ministry of corporate affairs and is accessed very easily by the individual. One can check the Company registration number, type of company, date of incorporation, charges of a company, directors of the company, etc. from the site. The balance sheets and other documents of a company along with annual returns are also available on the website on payment of appropriate fees.

Procedure to Check Status of the Company on MCA

Steps to check company registration:

  • Step 1 – Go to MCA website- http://www.mca.gov.in/.
  • Step 2 – Go to ‘MCA Services’ tab. Click on ‘View Company/LLP Master Data’ from the drop down.
  • Step 3 – Enter the companies CIN. Enter the captcha code, click on ‘Submit’. You can also search for CIN by clicking on the search icon beside ‘Company/LLP Name’ field.

What Kind of Information is available on the MCA Website?

The information that you can obtain from a particular company is mentioned below:

  • CIN (Corporate Identification number)
  • The Company Name
  • The Registration Number
  • The category as well as the sub-category of the company
  • Class of the company
  • Authorized Capital of the company
  • Paid up Capital of the company
  • Number of members (applicable in cases where a company is not having a share capital)
  • Date of Incorporation
  • Registered address of the company
  • Official email Id
  • Whether the company is registered or not
  • Date of last AGM
  • Date of latest Balance Sheet
  • Company Status (of e-filing)

How to Verify from MCA Website if a Company is Registered or not?

If any Company claims to be registered with MCA/Registrar of Companies (ROC), you may ask them for the CIN (Company Incorporation Number) which is allotted by ROC (each registered company has a unique CIN allotted). If you could not find the Company Name either using name or CIN provided, you can be sure that it’s not registered with Registrar of Companies/Government of India.  Only LLP, Private Limited Company & Public Company Limited Status can be obtained using MCA website. Status of entities registered as Sole Proprietorship or Partnership Firm cannot be obtained through MCA website.

Rules for Picking up Name for a New Company

The Registrar of Companies (ROC) across India expect an applicant to follow a few naming guidelines. Some of them are subjective, which means that approval can depend on the opinion of the officer handling your application. However, the more closely you follow the rules listed below, the better your chances of approval.

1. Unique Component:

In Flipkart Internet Private Limited, Flipkart is the unique component. Now, once taken, the name Flipkart will not be given to any other business within the suffix Internet or even related categories (E-commerce and Online Solutions, for example). But there is some subjectivity, too. Some RoCs may not even approve the name Flipkart Chemicals Private Limited, reasoning that the e-commerce brand Flipkart is too well-known. Similar sounding names would also be rejected (so no Flipcart ).

2. Blacklist:

Abbreviations, adjectives and generic words are rejected. So BBC or XYZ would be rejected, as would Good Quality Biscuits. The words bank, exchange and stock exchange, unless approved by RBI or SEBI, would also be rejected.

3. No Common Trademark:

There should not be a registered trademark by the same name on the HYPERLINK “http://ipindia.nic.in/” \t “_blank” IP India website. If there is one, the name can only be approved if you are able to get a No-Objection Certificate from its owner authorizing you to use it.

4. Descriptive Component:

In Biocon Research Private Limited, the word ‘Research’ describes the business the company is into. You cannot have ‘Research’ in your name if you’re, say, in the logistics or restaurant business.
